Workplace Inspections in Austria: Required Documents and Heavy Fines for Non-Compliance

The Austrian workplace can be subject to unannounced visits by the financial police, the labor inspectorate, or—on construction sites—controllers from the construction workers’ holiday and severance pay fund (BUAK). These inspectors usually check whether workers are properly insured, paid the correct wages, and if all necessary documents are available on site. For employees sent by Slovak companies, key documents include the A1 certificate, the ZKO3 notification, and German-language wage records.

Financial Police: Employment Registration and Wages

The Finanzpolizei operates under the Austrian Office for Fraud Prevention (Amt für Betrugsbekämpfung). Their checks cover businesses, workplaces, and external sites, looking into whether all employees were registered before starting work, as well as identifying fake registrations or fraudulent postings.

For employees of Austrian companies, the rule is straightforward: employers must notify the health insurance provider before the employee starts work, supplying at least the employer’s account number, the employee’s name, insurance number or date of birth, location, and start date. Additional data must be provided within seven days. If you’re found working without proper registration, it is primarily the company that faces consequences.

Sent by a Slovak Company? These Documents Are Mandatory

If you are working in Austria as an employee of a Slovak employer, you are considered a posted worker under Austria’s law against wage and social dumping (LSD-BG). Such postings must be reported to the central coordination office (ZKO): use the ZKO3 form for postings, and the ZKO4 form for staff leasing.

According to the German agency GTAI, the following documents must be available on site in German during the posting: a completed ZKO3 notification, the A1 certificate, and either the employment contract or a written summary of its content (Dienstzettel). You can find contract templates for review at Aktualizovane.sk.

Wage documents are also essential. This includes payslips, proof of wage payments or bank transfers, documents regarding wage classification, and records of working hours for the duration of the posting. These records must be available either physically on-site or electronically accessible during an inspection.

The Vienna law firm Brandauer warns that missing the A1 certificate can trigger compulsory Austrian insurance and additional penalties. ZKO notification and the A1 certificate are separate requirements; fulfilling only one is not sufficient.

Labor Inspectorate: Working Time and Safety

The second authority is the Arbeitsinspektorat (Labor Inspectorate). According to their presentation to the Austrian Chamber of Commerce, inspectors can visit any business or construction site at any time, typically without prior notice. They are permitted to review documents, take photographs, and make measurements—including checking working time records.

Not every deficiency leads to a penalty. The inspectorate notes that a detected issue does not automatically result in a criminal complaint; usually, the company is first given advice and guidance. wko

BUAK Inspections on Construction Sites

The construction industry has a dedicated inspector. BUAK oversees all employees covered by the construction holiday and severance act. Inspections include wage documentation as required by the LSD-BG. If an employer isn’t present at the site, someone else must be available to provide information and show the required documents to inspectors.

A digital system can help: documents may be scanned and saved into the Bau-ID system, which qualifies as electronic availability of the required paperwork.

How Much Can Missing Paperwork Cost?

Fines are mainly imposed on employers, but workers may lose contracts or be removed from sites as a result of missing documents. According to the official Austrian government portal USP, failing to provide wage documents on request may result in fines up to €20,000; repeated offenses can lead to fines as high as €40,000. Obstructing an inspection or refusing access to documents also carries a maximum penalty of €40,000.

Proper registration pays off long-term as well: periods of insurance in Austria can count toward your pension from both countries later.

Quick Checklist Before Starting Work

Carry an identity document at all times. If you are employed by an Austrian company, check that you have been registered for insurance before your first day. If you are posted by a Slovak company, request a copy of your A1 certificate, ZKO3 notification, employment contract or Dienstzettel, and wage records in German.
